Privacy and Cookie Policy

Last updated: 2 November 2026

This notice is given under Article 10 of Turkish Law No. 6698 on the Protection of Personal Data ("KVKK"). It explains how your personal data is handled when you contact us or join our lessons or open water experiences. If the two versions differ, the Turkish text prevails.

1. Data controller

The data controller is Nilüfer Solak / Swimroad Adventure (Kapidag Peninsula, Erdek / Balıkesir, Türkiye). Contact: · .

2. How you reach us

This site has no accounts or database of its own. What you type into the contact form is not stored on our server: when you submit it, your details become a ready-made WhatsApp message, and you send that message yourself.

  • WhatsApp: The buttons and the form open WhatsApp. Your message and phone number are processed on the WhatsApp (Meta Platforms) service, under its own privacy terms.
  • Email: Correspondence is stored with our email provider (Google).
  • Phone: Your number shows on our phone when you call. Calls are not recorded.

Which channel you use is your choice, and none of them is the only way to reach us. If you'd rather not use WhatsApp, for example, you can call or email.

3. What data we process

  • Identity and contact: full name, phone number, email address
  • Enquiry details: the programme or route you're interested in, your messages, age group, swimming level
  • Booking details: age, athlete licence details, an emergency contact; for participants under 18, details of a parent or guardian
  • Health data: a health declaration and, where requested, a health report or health status certificate (special category data)
  • Images: photos and video, taken and used only with your explicit consent
  • Technical records: the IP address, browser details and time of visit logged by our web host's servers

4. Purposes and legal grounds

  • Replying to your enquiry and setting up a booking: formation and performance of a contract (Art. 5/2-c)
  • Meeting legal obligations and requests from public authorities: legal obligation (Art. 5/2-ç)
  • Protecting our rights in a dispute: establishing, exercising or protecting a right (Art. 5/2-e)
  • Keeping lessons and experiences safe, planning our service and running the site securely: legitimate interest (Art. 5/2-f)
  • Processing health data to assess whether you can safely take part: your explicit consent (Art. 6/3)
  • Using photos and video for promotion: your explicit consent (Art. 5/1)

Explicit consent for health data and images is taken separately and in writing. You can withdraw it at any time. This doesn't affect what was done before you withdrew, but without the health information needed for safety you may not be able to take part in that lesson or experience.

5. Who receives your data

We don't sell your data or share it with third parties for marketing. It may only be shared as follows:

  • Service providers: WhatsApp (Meta Platforms), email and font services (Google) and our web host. Their servers may be outside Türkiye. When you write to us through these channels, your message is processed on those systems. Transfers abroad fall under KVKK Art. 9.
  • Emergencies: health services, the Coast Guard and your emergency contact, where health and safety require it during a lesson or experience.
  • Authorities: competent public bodies, where the law requires it.

6. How long we keep it

  • Enquiries that don't lead to a booking: up to 1 year from the last contact
  • Lesson and experience records: 10 years after the relationship ends (the general limitation period in the Turkish Code of Obligations)
  • Health declarations and documents: up to 1 year after the lesson period or experience ends, or until any incident or dispute is resolved
  • Photos and video: until you withdraw your consent

When the period ends, data is deleted, destroyed or anonymised.

7. Your rights

Under KVKK Art. 11 you can ask whether your data is processed and why, and who it has been shared with. You can ask for inaccurate data to be corrected, for data to be deleted or destroyed, and for those who received it to be told. You can object to a result against you that comes solely from automated analysis, and claim compensation for damage caused by unlawful processing.

Send your request to the email address above, with details that confirm your identity. We will respond free of charge within 30 days. If you're not satisfied, you can complain to the Personal Data Protection Board (KVKK Board).

8. Cookie policy

Contacting us on your own initiative

If you choose to contact us by pressing a WhatsApp button or the contact form, sending an email or calling us, you are deemed to have accepted this Privacy and Cookie Policy. Simply browsing the site does not have this effect, and access to the site's content doesn't depend on accepting anything.

This acceptance is not consent to non-essential cookies. Analytics cookies are used only if you separately agree in the cookie window, and declining doesn't affect how you can use the site. Separate explicit consent is also taken for health data and images.

Third-party connections

  • Google Fonts: Fonts load from Google's servers, which means your IP address is sent to Google.
  • YouTube: The videos on the About page don't connect to YouTube until you press play. They then load in privacy-enhanced mode (youtube-nocookie.com).
  • WhatsApp and Instagram: These links take you to those services, where their own policies apply.

Changing your choice

You can also delete or block cookies and site data in your browser settings.
